DISCLAIMER, CONDITIONS AND NOTICES
BOA-BASE OUTDOOR ACTIVITIES LIMITED
Under the present disclaimer are being accepted the conditions as follows: The present refers to all means of travel on land, in the air and water, relevant to motor vehicles and involves all activities, services and usage of accommodations, whether they are provided inside or outside Greece or also are conducted by BOA-BASE OUTDOOR ACTIVITIES LIMITED or in any means related to skiing, rowing, rock climbing, hiking, rescuing and activities related to outdoor travel, including – without being restricted in these – as follows: sessions of sense of direction and instructions, transportation, sojourn, and entertaining activities besides skiing, rowing, rock climbing, hiking, rescue and outdoor travel. Henceforth the condition «Β.Ο.Α» refers to the organizing company with the proprietary name «BASE OUTDOOR ACTIVITIES LIMITED».The condition «participant-applicant» henceforth refers to the person who signs the present, who accepts the present conditions, and is the other contract part who accepts the contract with B.O.A and enjoys the activities that are offered by the first. Henceforth the condition “transport” refers to all means of transport out of road and in public roads or private roads, forest roads, and includes private vehicles, rented vehicles, boats, airplanes, private vehicles of participants, yachts, motor-driven vessels, snowmobiles, snowcat και helicopters which are offered from B.O.A. or are being defined from or in any way are being related with skiing, rowing, climbing, hiking, rescuing, activities of outdoor travel, including – without restricting only in these – the follow: loading, discharging and travels or movements around vehicles, motor -driven vessels, snowmobiles, snowcats and helicopters. The condition «damage» refers to all means of physical injury, psychological and emotional damage or injury in any way related with skiing, rowing, climbing, hiking, rescuing, activities of outdoor travel and activities of transport which include without being restricted by death, fractures, sprains, injuries, dislocations, amputations, frostbitten, hypothermia, mental trauma, stress, phobias and fears.
SECURITY MEASURES
BOA is responsible to take all the appropriate security measures and precautions and assure for the participants adequate and safe equipment which is appropriate for every activity and in combination with the weather conditions (such as helmets, ropes, special shoes, special clothing, special equipment, to offer instructions and precaution measures). Β.Ο.Α is able to warn on time the participant and pause the activity at all, even during the activity if it is being considered that the continuation of that can result in a dangerous or fatal situation due to the weather or geological or atmospheric phenomena.
WEATHER CONDITIONS
In the event that in specific place and time that have been programmed to be undertaken activities there is a forecast from the National Meteo Sercice for extremely weather phenomena, the prosecution of activities will be postponed until the restoration of weather phenomena or will be prosecuted in another place depending on B.O.A’s judgment and after all the participants will have been informed. Β.Ο.Α is not responsible for unpredicted weather phenomena such as floods, landslides, frost, avalanche, rainfalls, change of direction of wind, etc.
REASONS FOR EXCLUDING THE PARTICIPANT
In case of not conforming with the instructions of the instructors-guides related to the progress of the activity and the secure prosecution of that, the guides or the instructors remain the right to exclude the participant with no previous warning. The participants have the duty to follow to the letter all the instructions of the guides and always, even during the activity, to wear special shoes, special costume, special equipment and helmet. In case of willing breach of the present or of the conditions or of the appropriate safety measures by the participant he will be automatically excluded from the related activity. Furthermore, in case that in the beginning or during the activity is being found out that the participant is not capable to continue due to his physical situation or due to health reasons he/she will be excluded from the continuation of the activity for security reasons and will be led to the start point or to a safe place ad hoc. LIABILITY FOR DAMAGES CAUSED TO THE PARTICIPANT
B.O.A is not responsible for causing damages that derive from excluding reasons or from a sudden back out from the activity. B.O.A is not responsible as well as if the participant was excluded from the activity for security reasons and he denied his participation after being excluded. The participant resigns the rights of compensation, reparation, indemnification and reimbursement. B.O.A is not responsible for damages that were caused to the participant from his own liability (such as disobedience to instructions, breach of instructions, health problems that he didn’t divulged to B.O.A or other information such as ID information, age, allergies, etc that he concealed artfully). The participant knows, acknowledges and takes the risk and dangers that are being caused by force majeure and sudden wather phenomena, for which no man is responsible for and B.O.A couldn’t predict them.
LIABILITY FOR DAMAGES CAUSED TO B.O.A
Every participant that breaches the conditions and the instructions of the present and of the instructors – guides causing by deception damage to equipment and to professional reputation of B.O.A is obligated to compensate B.O.A according to the civil law. PARTICIPATION FEE
The cost of participation (fee) is being prepaid and is not being refunded even if the participant is being excluded from the activity due to willing breach of the conditions. In case that due to sudden weather phenomena the programmed activity is being postponed and is not being prosecuted in a specific place and time due to liability of B.O.A inside one month from the date that was about to be prosecuted, then the participant remains the right to get a refund of the participation fee after those 30 days (calendar) from the date that the activity was about to be prosecuted before it was postponed, removing the proper amount for seminar lessons related to the preparation of the prosecution of activities. In case that, due to transfer of the place where the activities are to be prosecuted, which is caused by force majeure, and as a consequence there is an increase of the costs of transport the participant will be charged properly in relation to the expenses that will arise.
USAGE OF PERSONAL DATA
The participant recognizes and accepts that B.O.A has the right to transmit his personal data to every collaborating company and provider of services and products for reasons of operating and computerization service, for statistic or historical reasons. In any time the users have the right to access their personal data and getting informed or even objecting to the further editing of their data based to the new GDPR for the protection of the personal data. Β.Ο.Α remains the right to use the email of the users with the aim to inform them regarding offers or newsletters. JURISDICTION OF DISPUTES
Any future judicial dispute that may arise in the future deriving from the present diclaimer the court jurisdiction will be in the Hellenic courts of Athens.
LAST CLAUSE
The acceptance and furthermore the sign of the present is obligated for the participation in the chosen activity from the participant- applicant.
