BOA-BASE OUTDOOR ACTIVITIES LIMITED
BOA-Base Outdoor Activities Limited sets forth the following terms and conditions with the acceptance of this disclaimer. These terms cover all activities, services, and transport related to land, air, and water travel, as well as any services provided within or outside Greece. The activities include but are not limited to skiing, rowing, climbing, hiking, rescue, and other outdoor activities, as well as accommodation use, transportation, and recreational services.
Definitions:
BOA: Refers to the company “BASE OUTDOOR ACTIVITIES LIMITED” that organizes and offers the aforementioned activities.
Participant-Applicant: The individual who signs and accepts the terms of this agreement and participates in the activities offered by BOA.
Transport: Refers to all means of transportation, public or private, including private vehicles, rental vehicles, boats, airplanes, snowmobiles, helicopters, and others, either provided or associated with BOA activities such as skiing, rowing, climbing, hiking, and rescue.
Damage: Refers to any type of physical, psychological, or emotional injury related to outdoor activities or transportation. This includes, but is not limited to, death, injuries, fractures, sprains, mental trauma, hypothermia, phobias, and anxiety.
Disclaimer for Participation in Activities
By participating in any activity organized by BOA Base Outdoor Activities, you acknowledge and fully agree to the following terms and conditions. These terms are based on Greek law and are designed to ensure the safety of all participants and clearly define the responsibilities of the company and its representatives.
1. Acknowledgment of Risks
All activities involve significant risks, which may include but are not limited to injury, disability, or even death. Participants acknowledge and accept that they voluntarily assume all risks associated with the activity, whether known or unknown. These risks may include:
- Falls from heights, collisions with objects, or rough terrain.
- Equipment failure or misuse.
- Sudden changes in weather conditions and other natural hazards.
2. Physical Condition and Health
Participants confirm they are in good physical health and free from any medical conditions that could affect their participation. Individuals with pre-existing medical conditions or those undergoing medical treatment must consult their doctor and inform the company before participation.
3. Compliance with Instructions
All participants are required to strictly follow the safety guidelines and instructions provided by the organizers and guides. Failure to comply with these instructions may result in removal from the activity for the safety of all involved.
4. Personal Responsibility
- Participants must use the provided equipment properly throughout the activity.
- Participants should immediately inform the guide if they feel unwell, uncomfortable, or at risk at any point during the activity.
5. Waiver of Liability for Accidents or Damages
BOA Base Outdoor Activities, its organizers, activity leaders, and third-party collaborators bear no responsibility for any injury, illness, or death that may result from participation in the activities. By joining, participants waive any legal right to make claims or lawsuits against the company, except in cases of proven gross negligence or willful misconduct.
6. Insurance Coverage
The company offers the option of insurance coverage, in accordance with the policies and regulations provided by insurance companies. However, it is the participant’s responsibility to ensure they have personal insurance to cover any injuries or damages that may occur during the activity.
7. Equipment Use
Participants are responsible for the correct use of the equipment provided. Any damage or loss of equipment due to negligence or misuse may result in additional charges.
8. Program Changes
Due to the nature of outdoor activities and their reliance on weather and other unpredictable factors, BOA Base Outdoor Activities reserves the right to modify, postpone, or cancel activities to ensure the safety of participants. In such cases, participants will be offered either a refund or the option to reschedule the activity, according to the company’s policies.
9. Legal Release from Liability
By agreeing to participate in the activities, participants accept that BOA Base Outdoor Activities and its affiliates are not liable for any damages, injuries, or losses that may occur during the activity, except in cases of proven gross negligence or willful misconduct. Participants acknowledge that they are participating at their own risk and fully accept the terms of this disclaimer.
Risk Management and Liability:
Participation in BOA activities involves inherent risks related to outdoor activities and transportation. Participants accept the terms and conditions and assume responsibility for any injury or damage that may occur.
BOA is not liable for any damage or injury that may arise from participation in activities or transport, and participants acknowledge this disclaimer by signing the agreement.
SECURITY MEASURES
BOA is responsible for implementing all necessary safety measures and precautions, ensuring that participants are provided with appropriate and safe equipment for each activity, tailored to both the activity and the prevailing weather conditions (e.g., helmets, ropes, specialized footwear, clothing, and equipment). BOA will also provide clear instructions and safety guidelines. Additionally, BOA reserves the right to warn participants and suspend any activity—whether before or during—if it is determined that continuing may pose a risk of danger or lead to hazardous or life-threatening situations due to weather, geological, or atmospheric conditions.
WEATHER CONDITIONS
In cases where the National Meteorological Service forecasts extreme weather phenomena at the scheduled time and location of the activities, the activities will either be postponed until weather conditions improve or relocated to an alternative site at BOA’s discretion. Participants will be informed accordingly. BOA is not liable for unforeseen weather phenomena, such as floods, landslides, frost, avalanches, rainstorms, or changes in wind direction, among others.
REASONS FOR EXCLUDING PARTICIPANTS
Participants who fail to comply with the instructions provided by the guides or instructors, regarding the conduct and safety of the activity, may be excluded from the activity without prior notice. All participants are required to strictly follow the guides’ instructions and continuously wear specialized shoes, clothing, equipment, and helmets. If a participant intentionally violates these terms or any prescribed safety measures, they will be automatically excluded from the activity. Additionally, if it becomes evident at the beginning or during the activity that a participant is physically unfit or unable to continue due to health reasons, they will be removed from the activity for safety reasons and directed either to the starting point or to a secure location.
LIABILITY FOR DAMAGES CAUSED TO THE PARTICIPANT
BOA is not responsible for damages resulting from exclusion reasons or sudden withdrawal from an activity. BOA also bears no liability if a participant is excluded from an activity for safety reasons and subsequently refuses to continue after being excluded. The participant waives any right to compensation, reparation, indemnification, or reimbursement. Additionally, BOA is not liable for damages caused by the participant’s own negligence, such as failure to follow instructions, health issues that were not disclosed to BOA, or intentional concealment of vital information (e.g., ID, age, allergies). The participant acknowledges and accepts the risks and dangers posed by unforeseen events and sudden weather phenomena, for which no party is responsible, and which BOA could not have predicted.
LIABILITY FOR DAMAGES CAUSED TO BOA
Any participant who violates the terms and instructions set forth in this document, or those provided by the guides and instructors, and thereby causes damage to BOA’s equipment or professional reputation through negligence or misconduct, is obligated to compensate BOA in accordance with civil law.
PARTICIPATION FEE
The participation fee is prepaid and non-refundable, even in cases where a participant is excluded from an activity due to willful violation of the terms. If an activity is postponed due to sudden weather phenomena and not conducted within one month from the original date, participants have the right to request a refund after 30 calendar days from the scheduled activity date. The refund will exclude any fees related to preparatory seminars or lessons for the activity. If the location of the activity is changed due to force majeure, resulting in increased transportation costs, the participant will be charged accordingly for any additional expenses incurred.
USAGE OF PERSONAL DATA
The participant acknowledges and agrees that BOA has the right to transmit their personal data to any collaborating companies and service or product providers for operational and computerization purposes, as well as for statistical or historical reasons. Participants have the right to access their personal data at any time, to be informed, and to object to further processing of their data, in compliance with the General Data Protection Regulation (GDPR) regarding personal data protection. BOA reserves the right to use participants’ email addresses to inform them about offers or newsletters.
JURISDICTION OF DISPUTES
Any legal disputes arising from this disclaimer will fall under the jurisdiction of the Hellenic courts of Athens.
FINAL CLAUSE
Acceptance and signing of this agreement are mandatory for the participant-applicant’s participation in the chosen activity.
